Every day, complaints are filed against the medical staff due to Negligence with health and nervous system inflammation -related issues. Negligence in the legal sense, means that one does not perform assigned task. The task that the legislator has placed on that person. The legislator in the Islamic Penal Code, adopted in 1392, Defines negligence as carelessness or omission and also includes lack of skill and non-compliance with state regulations as part of this. Omission: Nonperformance of an act which scientifically and technically is expected to be carried out. eg: Non-administration of antibiotics for bacterial meningitis. Carelessness: Performance of an action which scientifically and technically should not be done. eg: Prescribing antibiotics for a patient with a viral nervous system inflammation. Lack of skill: Includes cases in which the physician does not have the scientific and technical expertise necessary for a certain work. eg: Incorrect lumbar puncture. Failure to comply with government regulations: Namely, failure to pay attention to regulations, departmental letters, regulations of administrative superiors, medical system, Ministry of Health eg: Not having an autoclave at the health center. It is hoped that compliants against medical staff will be prevented by complying with legal requirements. |
